Please read the following terms & conditions of use carefully before using this website. All users of the site agree that access to and use of this site are subject to the following terms and conditions and other applicable laws. Product Click, Product Click, LLP., productclick.net describe the same company.

Bookings and shoots

When placing orders the client must give direction of how the item will be photographed. No client creative direction is allowed after the order begins. Changes or additions after the fact will result in additional fees. Contact us with any questions.

Pricing

Client must pay 100% payment to begin the order. Estimate and contract will be sent and must be approved via email prior to the order commencing. Usage of the image constitutes approval of the images.

Pricing and billing information

Pricing for the services is described on the site and is subject to change without notice. You agree to pay Product Click in advance any applicable fees for the services to be provided by Product Click under these terms. Product Click will bill your credit card for all fees. You will provide Product Click with accurate and complete billing information including legal name, address, telephone number, and credit card or debit card billing information. Product Click is not responsible for any charges or expenses (example overdrawn accounts, exceeding credit card limits) resulting from charges billed by Product Click. All fees will be paid in U.S. dollars and are due as set forth on the site. Product Click fees are exclusive of all taxes or duties.

Deposits

We require that you place a deposit with us when making a booking (“a deposit”). All deposits are forfeited and will be retained by Product Click if you do not complete the booking. Client must pay 100% payment prior to being the order.

Image Sizing and Resolution

Product Click delivers a high resolution image, which includes a buffer surrounding the product(s), of approximately 11in. x 14in. / 28cm x 35.5cm @300 DPI. Color matched and sRGB ready. No smaller than 5000 pixels on the length. They can be used in print but not in an oversized item such as billboard. This would have to be reviewed prior to shooting. No layered PSD files will be delivered. Only one final file, either TIFF or JPEG will be delivered. Raw files can also be delivered if the proper additional fee is paid as well. If you need more sizes or more choices, just contact us.

Returns/ Disposition of property abandoned by customers

All items received by Product Click will either be returned to customer at their expense or donated to a local organization. Any items not discussed will be removed from our premises within 20 days. Return of items is optional and must be requested. It is at the client’s expense.

Copyright

Image Copyrights remain the property of Product Click. Images may not be used in any other means but what is licensed on the invoice. Client may not resell the images or give the images to other vendors selling their product. Product Click retains the right to use and display all product photos taken for customers in promotional material print advertising and sample web galleries.

Ownership of the services

You may not copy or incorporate any of the content of the services into any work including your own website without Product Click written consent. You will be granted full rights for usage upon the completion of payment.

Warranty disclaimer

This site and the materials and products on this site are provided without warranties of any kind whether expressed or implied. Product Click disclaims all warranties expressed or implied including but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Product Click does not represent or warrant that the functions contained in the site will be uninterrupted or error free, that the defects will be corrected or that the site or the server that makes the site available are free of viruses or harmful components. Product Click does not make any warranties or representations regarding the use of materials on the site in terms of the correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise. We do promise to give you a file that will show off your product in the best way.

Limitation of liability

Product Click shall not be liable for any special or consequential damages that result from the use or the inability to use the materials on the site or the performance of the products even if the Product Click is not liable for shipments that are lost or damaged in transit or from the customer's location and Product Click. It is the responsibility of the customer to insure all packages’s shipment. If your products require insurance during shipment, please advise Product Click. before placing your order. If your items are valued at more than US $1000 please contact us prior to shipping your items to us.

Typographical errors

In the event that a Product Click product is mistakenly listed at an incorrect price, Product Click reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Product Click reserves the right to refuse or cancel any such orders whether the order has been confirmed or/and your credit card charged by Product Click. If your credit card has already been charged for the purchase and your order is cancelled, Product Click shall issue a credit to your credit card account in the amount of the incorrect price.

Termination

These terms and conditions are applicable to you upon the assessing the site and the completing the registration or shopping process. These terms and conditions or any part of them may be terminated by Product Click without notice at any time for any reason.

Notice

Product Click may deliver notice to you by means of e-mail, a general notice on the site or by other reliable methods to the address you have provided to Product Click. The locality of any legal action will be in Hanover County, Virginia, U.S.A.

Release

You hereby release and forever discharge Product Click from and hereby wave and relinquish each and any past present and future dispute, claim, liability action, and cause of action of every kind of nature that has arisen directly or indirectly out of acceptance of the modified terms. Unless prohibited by state or federal laws to which you are subject, you will indemnify, defend and hold Product Click, its employees and agents, harmless from any against any claims liabilities damages loss and expenses including without limitation reasonable attorney fees and costs arising out of in any way connection to your access to and use of services your product user product materials or user content. Your violation of a 3rd party rights including without limitation any intellectual property right or any publicity confidentiality property or privacy right you agree not to settle any claims without Product Click written consent. Product Click will use reasonable efforts to notify you of any such claims, actions or proceedings upon becoming aware of it.

Disclaimers of warranty

The services are provided on an “as is” and “as available” basis and without warranties of any kind expressly disclaims all warranties whether express or implied with respect to the services including but not limited to implied warranties of merchantability fitness for a particular purpose and non-infringement.

Product Click makes no warranty that the services will be uninterrupted, timely, secure or error free, that the services are free of viruses or other harmful components, that the services will be available or that data will be secure from unauthorized access.

Privacy

Product Click respects the privacy of its users. You understand and agree that, notwithstanding any measures taken to prevent unauthorized disclosure, use of or connection to the Internet provides the opportunity for unauthorized third parties to circumvent such precautions and illegally gain access to confidential information. Accordingly Product Click cannot and does not guarantee the privacy, security or authenticity of any information as transmitted over or stored in any system connected to the Internet.

Usage data

You acknowledge and agree that Product Click has the right to collect, extract, compile and analyze, usage, data analytics, statistics and other information resulting from your access to and use of the services (Usage Data). Product Click retains ownership of all rights, title and interest in and to usage data which may be used by Product Click and connection with its performance of its obligations under these terms for any lawful business purpose.

Retaining developed content

Product Click will retain samples in accordance with its then current content retention policies but not less than 20 days from the day of the applicable shoot. Following termination of your account, Product Click may but is not required to retain samples or other developed content relating to your shoots.

This agreement is binding

The Client may not assign or transfer this agreement, or any rights granted hereunder. This agreement binds and inures to the benefit Product Click, Client, Client’s principals, employees, agents, and affiliates are jointly and severally liable for the performance of all payments and other obligations hereunder. No amendment or waiver of any terms is binding unless set forth in writing and signed by the parties. However, the invoice may reflect, and the Client is bound by, oral authorizations for fees or expenses, which could not be confirmed in writing because of insufficient time. This agreement incorporates, by reference, Article 2 of the Uniform Commercial Code and the Copyright Act of 1976, as amended.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
